The scope of this privacy policy
This privacy policy describes the treatment of information provided or collected on websites and applications where posted. This includes our digital properties, apps and applications we make available on third-party sites or platforms. We follow this privacy policy in accordance with applicable law in the places in which we operate. In some cases, we may provide additional data privacy notices specific to certain products, practices or regions. Guests should read those terms in conjunction with this policy, and any additional materials shall not be construed to conflict with this policy.

Please keep in mind that when you provide information to us on a third-party site or platform, the information you provide may be separately collected by the third-party site or platform. The information we collect is covered by this privacy policy, and the information the third-party site or platform collects is subject to the third-party site or platform’s privacy practices. Data security, integrity and retention
The security, integrity and confidentiality of your information are extremely important to us. We have implemented technical, administrative and physical security measures that are designed to protect our customer and guest information from unauthorized access, disclosure, use and modification. We regularly review our security procedures to consider appropriate new technology and methods. Please be aware that, despite our best efforts, no security measures are perfect or impenetrable. We will retain your personal information only for the length of time needed to fulfill the purposes outlined in this privacy policy unless a longer retention period is required or permitted by law.

The types of information we collect
We collect two basic types of information, both of which are defined within this policy: Personal information and anonymous information. We also may use personal and anonymous information to create a third type of information: Aggregate information (also defined in this policy).

For example, we collect:
-
Registration information you provide to us when you create an account, enter a promotion or contest, or link your profile on a third-party site or platform with your registration account, such as your first name and surname, country of residence, gender, date of birth, email address, username, and password;
-
Transactional information you provide to us when you request information or purchase a product or service from us, such as your postal address, telephone number and payment information;
-
Information sent either one-to-one or within a limited group using our message, chat, post or similar functionality, where we are permitted by applicable law to collect this information;
-
Information we obtain from a third party, such as a site or platform provider, about the use of our applications on third-party platforms or devices;
-
Location information provided by a mobile or other device interacting with one of our sites or applications (including through beacon technologies) or associated with your IP address, where we are permitted by law to process this information;
-
Activity information about your use, and the use by any person(s) you authorize through your account, of our sites and applications, such as the content you view or post, how often you use our services, and your preferences; and
-
Usage, viewing, technical, and device data when you visit our sites, use our applications on third-party sites or platforms, or open emails we send, including your browser or device type, unique device identifier, and IP address.

We may ask for and receive your credit card information if and when you buy one of our products and/or services; however, we DO NOT store your credit card information on any of our servers or keep any records of your credit card numbers.

Credit card transactions are handled by established third-party merchant-processing companies that maintain PCI-DSS compliance. Our order fulfillment is done by our own team members. In the rare case of third-party fulfillment, the third-party company receives the information they need to create and deliver your order either virtually or physically through a third-party courier service. When collecting credit card information for online purchases, we offer secured server transactions that encrypt your information in transit to thwart someone from intercepting it and misusing it.

All components of our business online that are used to process payments meet and maintain the standards set for PCI-DSS compliance. To maintain PCI-DSS compliance, your payment, or PAN, data is not stored within our systems. Furthermore, all of the customer data we collect is protected against unauthorized access by physical security means. We also encourage our partners and service providers to adopt and follow stringent consumer privacy policies.

Any Personally Identifiable Information that may be gathered in this manner is solely for our use; however, a third-party advertising service partner may use this information in a non-personally identifiable aggregated form for its own purposes.
In addition, we may employ one or more third-party service partners that track the traffic on our websites; however, the only information that may be gathered by such third parties is Non-personally Identifiable Information with the exception of email addresses.

Changes to this privacy policy
From time to time, we may change this privacy policy to accommodate new technologies, industry practices, regulatory requirements or for other purposes.

Limitation of liability
-
The Company and/or its respective licensors, affiliates and suppliers make no representations about the suitability, reliability, availability, timeliness, lack of viruses or other harmful components, and accuracy of the information, software, products, services and related graphics contained within our websites for any purpose. All such information, software, products, services and related graphics are provided “as is” without warranty of any kind. The Company and/or its respective licensors, affiliates and suppliers hereby disclaim all warranties and conditions of merchantability, fitness for a particular purpose, workmanlike effort, title and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.
-
You specifically agree that the Company shall not be responsible for unauthorized access to or alteration or interception of your personal information/data, transmissions or other data, any material or data sent or received not sent or received, or any transactions entered into through our websites. You specifically agree that our Company and/or our websites are not responsible for any content sent using and/or included in our websites by any third party. You further agree that the Company and/or its respective licensors, affiliates and suppliers may make improvements and/or changes to our websites and/or may discontinue any part of our websites at any time.
-
In no event shall the Company and/or its respective licensors, affiliates and suppliers be liable for any hacking or hacking attempts — direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever, including, without limitation, damages for unauthorized access to, or alteration or interception of, your personal information/data, transmissions or other data, loss of use, data or profits, arising out of or in any way connected with the use or performance of our websites, or for any information, software, products, services and related graphics obtained through our websites, or otherwise arising out of the use of our websites, whether based on contract, tort, negligence, strict liability or otherwise, even if Premiere Radio Networks or any of its suppliers has been advised of the possibility of damages. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. If this limitation of liability or the exclusion of warranty set forth above is held inapplicable or enforceable for any reason, then the Company’s total and maximum liability for any type of damages shall be limited to your membership fee. If you are dissatisfied with any portion of our online community, or with any of these terms of use, your sole and exclusive remedy is to discontinue using our online community and have returned to you the unused pro-rata portion of your membership fee on a 52-week pro-rated basis.
Jurisdiction
This Privacy Policy is governed in accordance with, and under the laws of the State of Georgia and applicable United States Federal Law, without giving effect to any choice of law or conflict of law, rules or provisions (whether of the State of Georgia or any other jurisdiction), that could or would cause the application of the laws of any jurisdiction other than the State of Georgia.

-
Should any litigation arise out of the operation of this Policy, you hereby specifically agree that the court which shall have first jurisdiction in any legal matters pertaining to this Policy shall be a court of appropriate jurisdiction, which shall be located within Hall County, Georgia, USA.
